Truck drivers who are independent contractors are usually responsible for absorbing the costs of many items and resources required to perform their job duties. This can include the costs of owning, maintaining, and operating their own trucks. These independent contractors are also obligated to pay all of their own Social Security and Medicare taxes. They are also not covered by workers’ compensation and may not be covered by overtime pay and minimum wage regulations.
Determining If a Driver is an Independent Contractor Driver
Workers who are under financial control from an employer may be employees and not independent contractors. This control may take the form of the worker not being allowed to work for other companies, the employer owning or placing significant financial investment into the equipment the work must use, and the employer not reimbursing the worker for any expenses he or she incurs while conducting business for the company. Particularly if one or more of these business relationships are permanent and not temporary, the worker may be an employee and not an independent contractor.
